Stay Extension Warning
Under the Thai government's visa waiver program which allowed foreigners to stay in the Kingdom of Thailand–conditional on their previous stay privilege or permission–for the period from March 26 until October 31, 2020 without the need to apply for a visa extension at the Immigration Office, we have discovered that, since November 1 until the present, there have been reports of late submission by our Thailand Elite members for our visa extension service, which has led to many cases of overstays by our members.
This is to inform you that our Thailand Elite members whose visa expired during the exempted period and who failed to apply for a stay extension at the Immigration Office within a specified time limit will be subjected to an at least one-year ban from entering the Kingdom of Thailand and a fine according to the prescribed overstay penalties. The maximum fine of 20,000 baht will be applied to members whose visa has not been extended since November 1, which was overdue the allowed stay extension period; and members who remain in the Kingdom beyond January 29, 2021 will be forced to leave the country and be banned from entry for at least one year.
To be barred from the above-mentioned avoidable fine and entry ban, Thailand Elite highly advises our members to constantly be reminded of your permitted length of stay in your passport and proceed with your stay extension application immediately once due.
Thailand Overstay Regulations for Thailand Elite Members
1.Members on a Special Entry Visa (SE) will be granted a 90-day extension for each application.
SE visa given to Elite member joined before year 2009.
2.Members on a Privilege Entry Visa (PE) will be granted a 1-year extension for each application.
PE visa given to Elite member joined from year 2014 onwards.
According to order, No. 1/2558, dated November 27th, B.E. 2558 (2015), by The Minister of the Interior regarding classes of foreigners ineligible for entry to the Kingdom of Thailand, which was promulgated in the Royal Thai Government Gazette with immediate effect on March 20th, B.E. 2559 (2016) at 00.01 a.m. local time, the following are the advisable and required practice and regulations to be complied with by foreigners seeking a stay in the Kingdom of Thailand.
1.Once arrived in the Kingdom of Thailand, a foreigner shall not stay in the Kingdom longer than the period of a stay permit.
2.A foreigner who overstayed in the Kingdom of Thailand before the order’s date of enforcement of March 20th, B.E. 2559 (2016) can surrender to the authorities at the immigration checkpoints before being allowed to leave the Kingdom and pays a fine of 500/day, but not exceeding 20,000 baht.
3.In the event that a foreigner overstayed in the Kingdom of Thailand and failed to leave the country before the order’s date of enforcement of March 20th, B.E. 2559 (2016), the foreigner will face a fine of 500 baht/day, but not exceeding 20,000 baht, and will be banned from re-entering the Kingdom of Thailand for the respective period as follows:
In case of a surrender to immigration authorities
3.1 An overstay of more than 90 days, a foreigner will be banned from re-entering the Kingdom for 1 year, starting from the date of departure.
3.2 An overstay of more than 1 year, a foreigner will be banned from re-entering the Kingdom for 3 years, starting from the date of departure.
3.3 An overstay of more than 3 years, a foreigner will be banned from re-entering the Kingdom for 5 years, starting from the date of departure.
3.4 An overstay of more than 5 years, a foreigner will be banned from re-entering the Kingdom for 10 years, starting from the date of departure.
In case of being arrested or prosecuted
3.5 An overstay of less than 1 year, a foreigner will be banned from re-entering the Kingdom for 5 years, starting from the date of departure.
3.6 An overstay of more than 1 year, a foreigner will be banned from re-entering the Kingdom for 10 years, starting from the date of departure.
An Important Message from the Immigration Department
The Immigration Department of the Royal Thai Police would like to bring your attention to the new regulations when it comes to overstaying your visa. Starting from March 20, 2016 onwards, instead of paying a fine for staying in the Kingdom of Thailand on an expired visa, the penalty now includes a ban from entering the country. The length of the ban depends on the period of overstay as follows :

According to Ministry of Interior’s Order 1/2558 Regarding Classes of Aliens Ineligible for Admission to the Kingdom of Thailand
- When entering the Kingdom of Thailand, please be mindful of the last day on your stay permit and DO NOT stay longer than the permitted date.
- If you have already overstayed beyond the permitted date, you must leave the country before the order’s enforced date (20 March 2016).
- If you have already overstayed beyond the permitted date and do not leave the country before the order’s enforced date (20 March 2016), you will be banned from re-entering the Kingdom of Thailand as shown in the details below:Alien Surrendered to Authorities:Alien Being Arrested and Prosecuted:
- An alien who overstays more than 90 days beyond his/her permitted date will be banned from re-entering the country for 1 year, starting from the departure date.
- An alien who overstays more than 1 year beyond his/her permitted date will be banned from re-entering the country for 3 years, starting from the departure date.
- An alien who overstays more than 3 years beyond his/her permitted date will be banned from re-entering the country for 5 years, starting from the departure date.
- An alien who overstays more than 5 years beyond his/her permitted date will be banned from re-entering the country for 10 years, starting from the departure date.
- An alien who is caught overstaying less than 1 year beyond his/her permitted date will be banned from re-entering the country for 5 years, starting from the departure date.
- An alien who is caught overstaying more than 1 year beyond his/her permitted date will be banned from re-entering the country for 10 years, starting from the departure date.
- If you have already overstayed beyond your permitted date before the order’s enforced date (20 March 2016), you may surrender to the authorities at the Immigration Checkpoint (land border, seaport, and airport). You must pay a fine of 500/day, but not exceeding 20,000 baht before you are allowed to leave the Kingdom of Thailand.
